Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Narrative Guides LLC, a Texas limited liability company doing business as Narrative Guides ("Company," "Narrative Guides," "we," "us," or "our"). These Terms govern your access to and use of the Narrative Guides mobile application, website located at narrativeguides.com, and all related services, features, software, and content provided by the Company (collectively, the "Service"). The Service provides a location-based platform that delivers GPS-triggered audio tours, storytelling experiences, and related content associated with geographic locations and participating businesses.

By downloading, installing, accessing, creating an account for, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and any policies referenced herein, including the Company's Privacy Policy. If you do not agree to these Terms, you must immediately discontinue use of the Service.

1. Eligibility and Acceptance of Terms

By accessing or using the Service, you represent and warrant that: you are at least thirteen (13) years of age, or sixteen (16) years of age if you reside in the European Economic Area, or the minimum age required under applicable law; if you are under eighteen (18) years of age, you have obtained the consent of a parent or legal guardian to use the Service; you have the legal capacity and authority to enter into a binding agreement with the Company; and your use of the Service complies with all applicable laws, regulations, and these Terms.

If you access or use the Service on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms. In such cases, the terms "you" and "your" shall refer to that entity as well as the individual acting on its behalf.

The Company reserves the right to refuse access to the Service, suspend accounts, or terminate access to the Service at its sole discretion for violations of these Terms or applicable law.

2. The Service

2.1 Description of the Service

Narrative Guides provides a location-based audio storytelling platform that delivers synthesized narration triggered by GPS location as users travel through designated points of interest. The Service may be accessed through the Narrative Guides mobile application and related software tools. The Service may include, without limitation: "Anchor Tours", which are free audio tours available within the platform; "Pioneer Routes", which are paid or premium audio tour experiences; local merchant promotions, offers, or discount features associated with participating businesses; and tools allowing users to import, create, or customize audio tours for personal use within the Service. The Company may modify, update, expand, or discontinue features of the Service at any time without prior notice.

2.2 Navigation Disclaimer

The Service is not a navigation application and does not provide driving directions, route planning, turn-by-turn guidance, or other navigation functionality. Users are solely responsible for selecting and using an appropriate navigation application (such as Google Maps, Apple Maps, Waze, or similar services) for routing and navigation. You agree that: you will follow your navigation application and not rely on the Service for navigation or driving instructions; you will comply with all traffic laws and applicable regulations while operating a vehicle; and you will exercise independent judgment and situational awareness at all times while traveling. Additional safety provisions are described in Section 8 (Safety). Narrative Guides does not monitor road conditions, traffic patterns, construction zones, or other hazards that may affect your travel.

2.3 No Monitoring of Travel Conditions

Narrative Guides does not monitor or provide information regarding road conditions, traffic patterns, construction zones, hazards, weather conditions, or other travel-related risks. The Company makes no representations or warranties regarding the safety, accessibility, or suitability of any location referenced within the Service. Users assume full responsibility for their travel decisions and for evaluating any risks associated with visiting or traveling through locations referenced in the Service.

3. Accounts

3.1 Registration

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information as necessary to keep it accurate and current.

3.2 Age Requirement

You must be at least thirteen (13) years of age, or sixteen (16) years of age if you reside in the European Economic Area (EEA), to create an account. If you are under eighteen (18) years of age, you represent and warrant that you have the consent of a parent or legal guardian to use the Service.

3.3 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately at support@narrativeguides.com if you become aware of any unauthorized access to or use of your account.

3.4 Electronic Communications

By creating an account or using the Service, you consent to receive electronic communications from Narrative Guides, including service announcements, legal notices, updates to these Terms, and other communications related to your account or the operation of the Service.

4. Free and Paid Content

4.1 Anchor Tours (Free)

Narrative Guides may provide a catalog of free audio tours ("Anchor Tours") available through the Service. Anchor Tours may include sponsored mentions from local businesses ("Sponsored Mentions"), affiliate recommendations, or other commercial content. By using Anchor Tours, you acknowledge that such tours may contain promotional material or paid placements that help support the availability of free content on the platform.

4.2 Pioneer Routes (Paid)

The Service allows users to create or purchase custom audio tours known as "Pioneer Routes." The current purchase price for creating a Pioneer Route is $29.99 USD, or the price displayed within the Service at the time of purchase. Narrative Guides reserves the right to modify pricing for Pioneer Routes at any time. Payments are processed by a third-party payment processor, currently Stripe. Narrative Guides does not store or process credit card information directly. All prices are displayed in U.S. Dollars (USD) unless otherwise specified. Applicable taxes may be added where required by law.

4.3 The Equalizer Refund

Users who create a new Pioneer Route may be eligible for a partial refund under the "Equalizer" program, which may provide a refund of up to $15.00 USD. Eligibility requirements, refund conditions, and the timing of any Equalizer credit will be displayed within the Service at the time of purchase. Narrative Guides reserves the right to determine eligibility and processing of Equalizer refunds at its reasonable discretion.

4.4 Pioneer Royalties

Pioneer contributors may earn royalties when other users purchase tours that include segments originally contributed by the Pioneer. Royalties are calculated and distributed through Stripe Connect or another designated payment provider, subject to the royalty structure displayed in the Pioneer Dashboard. Royalty eligibility applies for three (3) years from the date the segment is created, unless otherwise specified. Narrative Guides reserves the right to modify royalty structures, rates, or eligibility criteria for future content or future transactions upon thirty (30) days' notice through the Service or Pioneer Dashboard.

4.5 Refund Policy

Because Pioneer Routes involve digital content that is generated or synthesized at the time of purchase, all sales are generally final and non-refundable. However, if the Service fails to deliver the purchased audio content due to a verified technical error attributable to Narrative Guides, you may request a refund within seven (7) days of the transaction by contacting: support@narrativeguides.com. Narrative Guides reserves the right to investigate refund requests and determine eligibility based on the circumstances of the request.

5. User-Generated Content

5.1 Your Content

When you create a Pioneer route, import an itinerary, submit reviews, or otherwise contribute content ("User Content"), you retain ownership of the underlying ideas and information you submit. By submitting User Content through the Service, you grant Narrative Guides a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, synthesize into audio, distribute, display, and otherwise process such User Content in connection with operating, improving, and promoting the Service. User Content may be processed or transformed by automated systems, including artificial intelligence tools, in order to generate narration, summaries, or other features of the Service. This license enables Narrative Guides to operate the platform and does not affect any royalties payable under the Pioneer Program described in Section 4.

We reserve the right to review, edit, or remove any User Content that violates these Terms or our content policies, without prior notice.

5.4 Ownership of Generated Content

Narrative Guides owns all artificial intelligence generated narration scripts, synthesized audio recordings, compilations, and presentation of tour content created using Pioneer Content ("Narrative Content"). Pioneer contributors retain ownership of the underlying route structures, stop names, and written descriptions they submit.

6. Merchant Program

6.1 For Users

Merchant discounts ("Verified Reveals") are offers provided by independent local businesses. Narrative Guides facilitates the connection but does not guarantee the availability, quality, or honoring of any merchant discount. If a merchant fails to honor a discount, you may report it through the app. Narrative Guides does not control, endorse, or guarantee the quality, legality, safety, or availability of any merchant products, services, or discounts offered through the Service. All transactions, purchases, or interactions with merchants are solely between you and the merchant, and Narrative Guides shall not be responsible for any disputes, losses, damages, or injuries arising from such interactions.

6.2 For Merchants

Merchants participating in the Pay-per-Play (PPP) program are governed by the separate Merchant Partnership Agreement. These Terms of Service apply to Merchants' use of the Service as users.

7. Partner Program

7.1 Affiliate Links

Partners (influencers, content creators, tourism boards) receive unique referral links and earn commissions on qualifying transactions. Commission rates and terms are specified in each Partner's dashboard.

7.2 Partner Obligations

Partners agree to disclose their affiliate relationship with Narrative Guides in accordance with FTC guidelines and applicable advertising disclosure laws in their jurisdiction.

8. Safety — Critical Section

8.1 Not a Navigation Tool

Narrative Guides does not provide driving directions. The Service delivers entertainment and educational audio content triggered by your GPS location. You must use a separate navigation application for all driving directions.

8.2 Your Responsibility

You are solely responsible for your safety and the safety of your passengers at all times while using the Service. This includes but is not limited to:

8.3 Safety Disclaimer Acknowledgment

Before each tour, you will be presented with a safety disclaimer that you must acknowledge. By acknowledging the disclaimer and using the Service, you confirm that you understand and accept that: the Service is for entertainment only; the Service is not a navigation tool; your safety is your responsibility; you will follow your navigation app and obey all traffic laws.

8.4 Route Accuracy

While we make reasonable efforts to verify that tour routes follow public, paved roads, we do not guarantee the accuracy, safety, or accessibility of any route. Road conditions change. Construction, closures, weather events, and seasonal restrictions may affect any route at any time.

8.5 Audio Content Accuracy

Tour narration is generated by artificial intelligence and may contain factual errors. The audio content is provided for entertainment and general informational purposes only. Do not rely on tour narration for safety-critical decisions including but not limited to: road conditions, weather, wildlife hazards, or emergency information.

8.6 Assumption of Risk

BY USING THE SERVICE WHILE DRIVING, RIDING IN A VEHICLE, OR WALKING NEAR ROADWAYS, YOU ACKNOWLEDGE THAT SUCH ACTIVITIES INVOLVE INHERENT RISKS INCLUDING DISTRACTION, VEHICLE COLLISIONS, PERSONAL INJURY, PROPERTY DAMAGE, OR DEATH. YOU VOLUNTARILY ASSUME ALL RISKS ASSOCIATED WITH USING THE SERVICE WHILE DRIVING OR WALKING, INCLUDING ANY DISTRACTION CAUSED BY AUDIO CONTENT OR LOCATION-BASED FEATURES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AGREE THAT NARRATIVE GUIDES SHALL NOT BE LIABLE FOR ANY CLAIM ARISING FROM SUCH RISKS, INCLUDING CLAIMS BASED ON ALLEGED NEGLIGENCE.

8.7 Location Verification

The Service uses GPS location data during active tours to trigger audio narration and to verify user proximity to participating merchants in order to validate Pay-Per-Play billing events. Location data is collected only during active tours and is processed in accordance with our Privacy Policy.

8.8 No Reliance

You should not rely on the Service for navigation instructions, safety decisions, emergency information, or professional advice of any kind.

9. Intellectual Property

9.1 Our Content

All audio narration, app design, software, logos, and other materials provided through the Service ("Narrative Content") are owned by Narrative Guides or our licensors and are protected by copyright, trademark, and other intellectual property laws.

9.2 Limited License to You

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms.

9.3 Restrictions

You may not: (a) copy, redistribute, or resell any Narrative Content; (b) use the Service to create a competing product; (c) reverse engineer the app or its audio synthesis pipeline; (d) use automated tools to scrape, download, or bulk-access tour content; (e) remove any copyright or attribution notices.

10. Payments and Billing

10.1 Payment Processor

All payments are processed by Stripe, Inc. By making a purchase, you agree to Stripe's terms of service.

10.2 Pricing

Prices are displayed in USD and may change at any time. Price changes do not affect previously completed purchases.

10.3 Taxes

You are responsible for any applicable taxes on your purchases. We will collect and remit taxes where required by law.

11. Limitation of Liability

11.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT.

11.2 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NARRATIVE GUIDES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO: PERSONAL INJURY, PROPERTY DAMAGE, LOST PROFITS, DATA LOSS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY.

11.3 Liability Cap

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.

11.4 Driving and Safety

WITHOUT LIMITING THE FOREGOING, WE SHALL NOT BE LIABLE FOR ANY INJURY, DEATH, OR PROPERTY DAMAGE ARISING FROM YOUR USE OF THE SERVICE WHILE OPERATING A VEHICLE, WALKING, OR ENGAGING IN ANY PHYSICAL ACTIVITY. YOU ACKNOWLEDGE THAT THE SERVICE IS NOT A NAVIGATION TOOL AND THAT YOU USE IT AT YOUR OWN RISK.

11.5 Service Availability

Narrative Guides does not guarantee uninterrupted or error-free operation of the Service. The Service may be unavailable due to maintenance, technical failures, internet disruptions, or failures of third-party systems.

12. Indemnification

You agree to indemnify, defend, and hold harmless Narrative Guides, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising out of: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third party's rights; or (d) your User Content.

13. Dispute Resolution

13.1 Governing Law

These Terms and any dispute arising out of or relating to these Terms or the Service shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict-of-law principles.

13.2 Informal Dispute Resolution

Before initiating any arbitration or court proceeding, you agree to first contact Narrative Guides at legal@narrativeguides.com and attempt to resolve the dispute informally. The parties agree to attempt to resolve the dispute for at least thirty (30) days before initiating formal proceedings.

13.3 Binding Arbitration

If a dispute cannot be resolved informally, it shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The Federal Arbitration Act governs the interpretation and enforcement of this arbitration agreement. The arbitration shall be conducted: in the State of Texas, or remotely via video conference if permitted by the arbitration rules. Judgment on the arbitration award may be entered in any court of competent jurisdiction.

13.4 Class Action Waiver

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND NARRATIVE GUIDES AGREE THAT ANY DISPUTE SHALL BE RESOLVED ONLY ON AN INDIVIDUAL BASIS. YOU WAIVE ANY RIGHT TO PARTICIPATE IN: CLASS ACTION LAWSUITS; CLASS ARBITRATIONS; REPRESENTATIVE ACTIONS.

13.5 Arbitration Opt-Out

You may opt out of this arbitration agreement within thirty (30) days of creating your account by sending written notice to: legal@narrativeguides.com. Your notice must include: your full name; the email address associated with your account; a statement that you wish to opt out of arbitration.

13.6 Small Claims Court Exception

Either party may bring an individual claim in small claims court if the claim qualifies and remains within that court's jurisdiction.

13.7 Injunctive Relief

Nothing in this section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction to prevent actual or threatened: infringement or misappropriation of intellectual property rights; unauthorized access to or misuse of the Service; violations of confidentiality or data security obligations. Such claims may be brought in court without first engaging in arbitration.

13.8 International Users

If you reside outside the United States and mandatory arbitration or class action waivers are prohibited by the consumer protection laws of your jurisdiction, those provisions shall not apply to you to the extent required by law. In such cases, disputes may be brought before the courts of your jurisdiction of residence, and you retain any consumer rights granted by applicable local law.

14. Termination

14.1 By You

You may stop using the Service and delete your account at any time.

14.2 By Us

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice.

14.3 Effect of Termination

Upon termination: (a) your license to use the Service ends immediately; (b) you lose access to any purchased content (except content already downloaded to your device); (c) Pioneer royalties earned but unpaid will be paid out within 30 days.

15. General

15.1 Entire Agreement

These Terms, together with our Privacy Policy and any applicable Merchant or Partner agreements, constitute the entire agreement between you and Narrative Guides.

15.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.

15.3 No Waiver

Our failure to enforce any provision does not waive our right to enforce it later.

15.4 Assignment

Narrative Guides may assign or transfer these Terms, and any associated rights or obligations including royalty obligations under the Pioneer Program, in connection with a merger, acquisition, corporate reorganization, or sale of assets. You may not assign your rights or obligations under these Terms without our prior written consent.

15.5 Changes

We may modify these Terms at any time by posting updated Terms on our website. Material changes will be communicated via email or in-app notification at least 30 days before taking effect.

15.6 Force Majeure

Narrative Guides shall not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including but not limited to natural disasters, internet outages, government actions, labor disputes, cyber incidents, or failures of third-party service providers.

15.7 App Store Notice

These Terms are between you and Narrative Guides and not with Apple Inc. or Google LLC. Apple and Google are not responsible for the Service, its content, maintenance, or support.

15.8 Data Retention

Personal data collected through the Service is retained only for as long as necessary to operate the Service, comply with legal obligations, resolve disputes, and enforce agreements, as described in our Privacy Policy.
